The plaintiff, a resident of Woodbury, Connecticut, was a Chief Financial Marketing Officer for an international company with its home office in New York City. She was rear ended in Bethel, Connecticut on Interstate 84 by a Newtown, Connecticut defendant. The plaintiff suffered vertigo, a concussion without loss of consciousness, headaches, neck strain and low back strain. She also had prior low back surgery and was involved in a second post-accident collision. The plaintiff treated with chiropractic physician Dr. Steven Levy of Woodbury, Connecticut and neurologist Dr. Jan Mashman of Danbury. A law suit was filed in the Waterbury Superior Court. The case was then mediated in front of Attorney Richard Mahoney of Wethersfield, Connecticut. The liability carrier tendered full policy limits of $100,000.00 at the mediation. The thrust of the plaintiff's damage claim focused on impairment of the plaintiff's earning capacity. The plaintiff was also assigned a 5% impairment of her cervical spine along with a 5% impairment of her lumbar spine by her treating physician.
