$100,000.00 Automobile policy tendered by Geico after a trial management conference before the Honorable Joseph Pellegrino for a rear end collision case filed in the Waterbury Superior Court. The plaintiff, from Terryville, Connecticut, was a culinary school graduate who operated a coffee house and catering business in Prospect, Connecticut. She was rear ended in Prospect, Connecticut on Scott Road while riding as a passenger in a motor vehicle driven by her husband.
The plaintiff suffered cervical strain, an aggravation of preexisting degeneration at the low back, a rotator cuff tear and SLAP tearing at the right shoulder causally related to her rear end collision. The plaintiff treated with pain management specialist Dr. David Levi of Danbury who administered low back injections. Injections to the plaintiffs low back included radiofrequency ablation at the LS-Sl. The plaintiffs right shoulder internal derangement was diagnosed by Dr. Patrick Kwok of the Orthopaedic Specialty Group, PC. of Fairfield, Connecticut. The plaintiff was assigned a 13% impairment of the low back by chiropractic physician Dr. Steven Levy of Woodbury, Connecticut.
The initial pre suit offer was $22,000.00. The carrier increased the offer to $52,000.00. These offers were rejected. On the eve of trial; GEICO tendered the full policy limits of $100,000.00 over four years after the accident. The plaintiff is now making an underinsured motorist claim after having exhausted the full policy limits available to the owner/operator tortfeasor.
